By using our website, requesting a quote, or selling a motorcycle to or through us, you agree to these Terms.

1About us & these Terms
We Buy Any Harley ("we", "us", "our") is a New Zealand business that helps owners sell their Harley-Davidson motorcycles. We present your motorcycle to a nationwide network of dealers to obtain a wholesale offer, can settle any finance owing on the motorcycle, and pay you by bank transfer when we collect it.
These Terms apply to the whole of your relationship with us, including your use of this website and any sale you make to or through us. If you do not agree to these Terms, please do not use our website or our service.
2Definitions
- "Motorcycle" means the Harley-Davidson motorcycle you ask us to quote on or sell.
- "Online quote" or "quote" means the indicative figure we provide based on the information you submit through our website.
- "Final offer" means the confirmed price we (or a dealer in our network) offer for the Motorcycle after inspection and verification.
- "Fee" means our success fee described in clause 11.
- "You" or "seller" means the person requesting a quote or selling the Motorcycle.
3Our service
Our service is to help you achieve the best wholesale price for your Motorcycle. In general terms, we:
- collect details and photos of your Motorcycle through our website;
- present it to dealers in our nationwide network to obtain offers;
- provide you with a final offer once the Motorcycle has been inspected and verified;
- where you accept, arrange collection, settle any finance owing, and pay you the balance.
We act as an intermediary and buyer's agent between you and our dealer network. We do not guarantee that any particular dealer will make an offer, or that any offer will be made at all.
4Quotes are estimates only
Any online quote is an indicative estimate based solely on the information and photos you provide. It is not a binding offer to buy your Motorcycle and does not create a contract.
5Information you give us
You agree that all information you provide about the Motorcycle and yourself is true, accurate and complete to the best of your knowledge. This includes the model, year, mileage/odometer reading, Warrant of Fitness and registration status, number plate, condition, service history, modifications, and any damage or faults.
We rely on this information to prepare your quote and to present the Motorcycle to dealers. If information is inaccurate or incomplete, your final offer may change or be withdrawn.
6Your warranties as seller
By offering to sell the Motorcycle to or through us, you confirm and warrant that:
- you are the legal owner of the Motorcycle, or are authorised by the owner to sell it;
- the Motorcycle is not stolen and its identifiers (VIN, engine and frame numbers, number plate) are genuine and unaltered;
- you have disclosed to us any money owing on the Motorcycle, including finance, lease or any security interest registered on the Personal Property Securities Register (PPSR);
- the odometer reading is accurate to the best of your knowledge and has not been tampered with;
- you have disclosed any material faults, damage, accident history or outstanding safety issues;
- the Motorcycle is not subject to any court order, dispute or third-party claim that would prevent its sale.
You agree to indemnify us for any loss we suffer as a result of any of these warranties being untrue (see clause 18).
7Inspection & final offer
Before any sale completes, the Motorcycle will be inspected and its details verified. Following inspection we will confirm a final offer. You are under no obligation to accept the final offer, and a binding sale only forms once you accept the final offer and the Motorcycle is collected.
We may decline to proceed, or adjust the final offer, if the Motorcycle differs from the information provided, if identity or ownership cannot be verified, or if undisclosed finance, damage or faults come to light.
8Finance owing & settlement
If money is owing on the Motorcycle, we can arrange to settle the outstanding balance directly with your finance provider from the sale proceeds. You authorise us to obtain a settlement figure from your finance provider for this purpose.
Where the finance owing is less than the agreed price, we pay you the balance. Where the finance owing is more than the agreed price, you remain responsible for paying the shortfall, and the sale will only complete once satisfactory arrangements for that shortfall have been made.
9Collection of the motorcycle
Where a sale is agreed, we arrange collection of the Motorcycle from an address in New Zealand at no cost to you. You must make the Motorcycle available for collection, along with the keys, registration details, service records and any other documents reasonably required.
You must ensure the Motorcycle is in the same condition as described and inspected when it is collected. If its condition has materially changed, we may re-inspect and adjust or withdraw the offer.
10Payment to you
Payment for the Motorcycle is made by bank transfer to a New Zealand bank account in your name, at the time of collection. You are responsible for providing correct bank account details. Cleared funds may take a short time to appear in your account depending on your bank.
11Our $99 fee
Our service fee is $99 (including GST) and is only payable if your sale goes through — that is, if you accept a final offer and the Motorcycle is sold. If no sale completes, no fee is payable.
Where a sale completes, the $99 fee may be deducted from the amount we pay you, or invoiced separately, as we agree with you at the time.
12Cancellation & withdrawal
You may withdraw from the process at any time before you accept a final offer and the Motorcycle is collected, at no cost. We may also decline or withdraw from a transaction at any time before completion — for example, if we cannot verify ownership or identity, if information proves inaccurate, or if we are unable to obtain a suitable dealer offer.
13Title, risk & ownership
Ownership of and risk in the Motorcycle passes to us (or the purchasing dealer) on collection and payment. Until that point, the Motorcycle remains your property and your responsibility, including keeping it insured and registered as required by law.
You are responsible for notifying the New Zealand Transport Agency (NZTA / Waka Kotahi) of the change of ownership as required, unless we agree to handle this on your behalf.
14Privacy
We collect personal information (such as your name, contact details, bank account details and information about your Motorcycle) so that we can provide our service. We use and store this information in accordance with the Privacy Act 2020.
We may share relevant information with dealers in our network, finance providers and service partners for the purpose of quoting on, verifying, settling finance on and purchasing your Motorcycle. We do not sell your personal information. You may request access to, or correction of, the personal information we hold about you by contacting us using the details in clause 21.
15Website & intellectual property
All content on this website — including text, layout, graphics and logos (other than third-party trademarks) — is owned by or licensed to us and is protected by law. You may not copy, reproduce or reuse it without our permission.
You agree to use the website only for lawful purposes and not to submit false information, upload harmful content, or interfere with the operation of the site.
16Your consumer rights
Nothing in these Terms is intended to limit any rights you have that cannot lawfully be excluded, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Where those Acts apply and cannot be contracted out of, our liability is governed by them and these Terms are read subject to them.
17Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss of profit, arising out of or in connection with our service, our website, or these Terms. Our total liability to you for any claim is limited to the greater of the amount of our Fee, or $500.
We do not warrant that the website will be uninterrupted or error-free, and quotes generated by the website are provided on the basis set out in clause 4.
18Indemnity
You agree to indemnify us against any loss, damage, cost or claim we suffer or incur arising from your breach of these Terms, from any of your warranties in clause 6 being untrue, or from any undisclosed finance, security interest, damage or ownership issue affecting the Motorcycle.
19Changes to these Terms
We may update these Terms from time to time. The version published on this website at the time you use our service is the version that applies. We recommend you review this page when you use the site. The "Last updated" date at the top shows when the Terms were last changed.
20Governing law
These Terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts.
